Terms of Sale

These Terms of Sale (the "Terms") govern the sale of the digital product "Apaisance" offered under the "Sunrisa Paris LLC" brand. By placing an order, the customer (the "Customer") acknowledges having read these Terms and accepts them in full.

1. Seller identity

The product is published and sold by:

Referred to below as the "Seller". As a US limited liability company, the Seller has no EU/UK VAT number and no European or national trade-register number; the EIN above serves as its identification number. Any request relating to an order or to these Terms may be sent to the email address above or by post to the Seller's registered address.

2. Product and educational nature

"Apaisance" is a digital educational self-help program, delivered as downloadable files (PDF document and related content). It is designed to support people going through menopause in living better with the associated experience, through information, relaxation and well-being content.

The product is educational and well-being in nature. It is not a medical device, not a treatment, and not a therapeutic service. It is not medical advice and cannot replace a consultation, diagnosis or follow-up by a healthcare professional. It comes alongside medical care, never in its place. The Seller makes no promise to cure, treat, relieve or reduce any symptom, including hot flashes or night sweats. The Customer remains responsible for consulting a healthcare professional for any medical question.

3. Price

The price of the product is €29 including all taxes (launch price, shown against a struck-through reference price of €39). This is a one-time purchase, with no subscription and no recurring payment. The exact final price, including all applicable taxes, is displayed on the sales page before the order is confirmed; that firm amount prevails.

The price is shown inclusive of applicable value added tax (VAT) or sales tax, which is collected and remitted by our payment provider on our behalf. The price may be shown in different currencies (euro, pound sterling, US dollar, etc.) depending on the country or the Customer's preferences; the amount actually charged may vary slightly with the exchange rate and any fees applied by the Customer's bank or payment provider. The Seller may change its prices at any time; the applicable price is the one displayed when the order is confirmed.

4. Order and acceptance of the Terms

Orders are placed online. The Customer selects the product, provides the requested information and pays through the secure payment provider.

By confirming payment, the Customer declares that they have read, understood and accepted these Terms in full. Acceptance of the Terms is a prerequisite for completing the order. The sale is deemed concluded once payment is confirmed. A confirmation email, including access to the product, is sent to the Customer.

5. Delivery

As the product is entirely digital, delivery is immediate and takes place by download and/or by sending an access link to the email address provided by the Customer, as soon as payment is confirmed. No physical medium is shipped.

It is the Customer's responsibility to provide a valid email address and, where relevant, to check their spam folder. In case of any access or download difficulty, the Customer may contact the Seller at contact@sunrisaparis.com.

6. Right to cancel / withdraw and digital content

Because the product is digital content supplied immediately upon confirmation of the order, the following applies depending on where the Customer resides.

Customers in the European Union (including Ireland)

Consumers resident in the EU benefit, in principle, from a 14-day right of withdrawal for the supply of digital content not delivered on a tangible medium (Directive 2011/83/EU; in Ireland, the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013). However, this right of withdrawal does not apply to digital content whose supply has begun after the Customer's prior express consent and their express acknowledgement that they thereby lose the right of withdrawal.

Customers in the United Kingdom

Consumers resident in the UK benefit, in principle, from a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. As with the EU regime, this right to cancel is lost for digital content once its supply has begun with the Customer's express prior consent and their acknowledgement that the right to cancel will be lost.

At the time of the order, the Customer is asked to confirm, by means of a dedicated, separate and un-ticked checkbox, that they:

If the Customer does not tick this dedicated box, they keep their full 14-day right to cancel / withdraw. This waiver, where validly obtained, concerns only the statutory 14-day right. It is separate from, and has no effect on, the 30-day "satisfied or refunded" commercial guarantee described in section 7, which remains fully applicable in every case.

7. 30-day "Satisfied or refunded" commercial guarantee

Regardless of any statutory right, the Seller voluntarily offers the Customer a 30-day "satisfied or refunded" commercial guarantee from the date of purchase.

If, within those 30 days, the Customer is not satisfied with the product, they may request a full refund by simply emailing contact@sunrisaparis.com, quoting their order reference. No detailed justification is required. The refund is made to the payment method used for the purchase, within a reasonable time of receiving the request.

This commercial guarantee is a benefit offered by the Seller in addition to the Customer's statutory rights. It is separate from any statutory guarantees and from the right to cancel / withdraw, and it deprives the Customer of no mandatory right they may have under applicable law.

8. Statutory rights on digital content

Nothing in these Terms affects the Customer's statutory rights.

For consumers in the European Union (including Ireland), the Customer benefits from the statutory guarantee of conformity applicable to digital content and services (Directive (EU) 2019/770): the Seller must supply digital content that conforms to the contract and is liable for any lack of conformity existing at the time of supply.

For consumers in the United Kingdom, the Consumer Rights Act 2015 provides that digital content must be of satisfactory quality, fit for purpose and as described. The 30-day commercial guarantee in section 7 goes beyond these statutory standards and applies in addition to the Customer's statutory rights, which remain unaffected.

9. Liability

As the product is educational and well-being in nature, the Seller guarantees no particular result; the effects experienced may vary from one person to another. The Customer uses the product under their own responsibility and remains the sole judge of whether to apply the suggestions offered, in consultation with a healthcare professional where appropriate.

The Seller shall not be liable for indirect losses arising from the use of, or inability to use, the product. The Seller takes reasonable steps to keep the files accessible, but does not guarantee the complete absence of interruption caused by technical factors beyond its control. Nothing in these Terms excludes or limits the Seller's liability where such exclusion would be unlawful under applicable law, including for death or personal injury caused by negligence, or for fraud.

10. Intellectual property

All content making up the "Apaisance" product (texts, PDF documents, visuals, audio, the "Sunrisa Paris LLC" brand) is protected by intellectual property law and remains the exclusive property of the Seller.

Purchase grants the Customer a personal, private and non-exclusive right of use. Any reproduction, distribution, resale, public sharing, making available to third parties or commercial exploitation of the product, in whole or in part, without the Seller's prior written authorization, is strictly prohibited.

11. Personal data

Personal data collected in connection with the order is processed in accordance with the Privacy Policy available on the site, where the Customer will find information on the data collected, its purposes, retention periods, and the rights available to them and how to exercise them.

As the Seller is established in the United States and uses processors (including the payment provider) that may process data outside the EU/UK, some of the Customer's personal data may be transferred outside the European Union and the United Kingdom. Such transfers are covered by appropriate safeguards, in particular the Standard Contractual Clauses (and, for UK transfers, the UK International Data Transfer Agreement or the UK Addendum). Details appear in the Privacy Policy.

12. Governing law and disputes

These Terms are governed by the law of the Seller's place of establishment (the State of New Mexico, USA). However, a consumer resident in the European Union or the United Kingdom keeps the benefit of the mandatory, more protective provisions of the law of their country of habitual residence (for the EU, Article 6 of Regulation (EC) No 593/2008, "Rome I"). Nothing in these Terms deprives a consumer of the protection afforded by those mandatory provisions.

In case of a dispute, the Customer is invited to contact the Seller first at contact@sunrisaparis.com to seek an amicable solution.

Amicable settlement and competent courts. Where a dispute is not resolved amicably, a consumer resident in the EU or the UK may bring proceedings before the courts of their place of residence, in accordance with the protective rules applicable to consumers, and may use any mediation or alternative dispute resolution scheme available in their country.

13. Language

This English version is provided for information and to make our terms accessible. The French version of our contractual documents is the authoritative reference and prevails in the event of any discrepancy. This does not affect any mandatory protection available to consumers under the law of their country of residence.

14. Miscellaneous

If any provision of these Terms is held void or unenforceable, the remaining provisions retain full effect. The Seller may amend these Terms at any time; the Terms that apply are those in force on the date of the order.
